I have a very similar problem, My niece; was cooking in my kitchen when the grease caught on fire, it burned the microwave, cabinet and there is some dry wall to be replaced. The insurance company has informed the landlord that all he has to pay is a deductible and that they will come after me to pay the full damages.... can they do that?

Yeah they can...do you have custody of your niece? is she a minor? if she is a minor and you do not have custody, and her parents have either an Home owners or renters policy there should be coverage under the liability portion of that policy. If not more than likely unless she is an adult you certainly may be held responible..and his deductible, they will come after that as well..

Yes, the insurer can recover the compensation from you….rather its just the way things happen in such situations.

I too will go with lori, if your niece is not staying with you and you don't have the custody of your niece, you may ask her parents to take care of the damages, otherwise, you may have to pay for the losses out-of-pocket or may have to turn the claim to your insurer.

Lori and Jeremy are both right on.

Do you have renters insurance? The liability portion might protect you if your neice or her parents do not have coverage.

I don't have renters insurance (but I will by the end of the week) I spoke with a state farm agent and she advised me that the landlords insurance (he has landlord tenant insurance) and that unless the fire was arson then it is covered. She advised me to call the insurance commissioner for the state of Missouri and file a complaint. I was also advised by a friend that if they come after me just keep appealing the judgment and they will drop the case because the amount collected is not worth the cost in legal fees.

Even you purchase the coverage now….you won't be covered for the damages already done. Anyways, you re required to pay for the coverage done by your niece.

It's covered but at the same time the responsible party for the damages is also required to pay for the claim. BTW, who's the State Farm agent?
